GENERAL CONDITIONS OF SALE

These conditions govern the sales of illustrations by the company Les Esquisseurs.

Article 1 - Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. In the case of an order to a country other than mainland France, you are the importer of the product(s) concerned. Outside the EU, customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Les Esquisseurs. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros. Les Esquisseurs reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time the order is validated and subject to availability. The products remain the property of Les Esquisseurs until full payment of the price. Please note: as soon as you take physical possession of the products ordered, the risks of loss or damage to the products are transferred to you.
Article 2 - Orders

Les Esquisseurs reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 3 - Validation of your order

Any order placed on the website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full acceptance of these general terms and conditions of sale, without exception or reservation. All data provided and the recorded confirmation will constitute proof of the transaction. You declare that you are fully aware of it. The order confirmation will constitute your signature and acceptance of the transactions carried out. A summary of your order information will be sent to you via the confirmation email address.

Article 4 - Payment

By confirming your order, you are obligated to pay the indicated price. Payment for your purchases is made through the secure PayPal payment system (express checkout).

Article 5 - Withdrawal / Cancellation

The majority of products sold by Lesesquisseurs.com are personalized. These products are manufactured according to the specific and individual wishes of the consumer and are therefore not pre-produced. As these are personalized products, which are manufactured based on the consumer's individual choice, the latter does not, in principle, have a right of withdrawal for these products.

Les Esquisseurs may exclude the following products and services from the right of withdrawal: products manufactured according to the consumer's specifications, which are not prefabricated and which are manufactured on the basis of an individual choice or decision of the consumer, or which are clearly intended for a specific person.

By accepting these General Conditions of Sale, the Customer expressly acknowledges having been informed of the withdrawal procedures.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to: The supply of services fully performed before the end of the withdrawal period and the performance of which has begun after the express prior agreement of the consumer and express waiver of his right of withdrawal. The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period. In the event of a returned package not received at a relay point within the 14-day withdrawal period, there will be no refund.

For non-personalized products:

    1. Notwithstanding the above provisions, the consumer, who has a right of withdrawal, may dissolve an agreement relating to the purchase of a product during a reflection period of 14 days without giving reasons. provided it is in perfect condition, i.e. unused, undamaged and in the original packaging. Any return of an item not meeting these conditions will not be accepted. Return costs are the responsibility of the customer, except in the case of non-compliance or an error on our part during shipping. We recommend using a tracked shipping service to ensure proper receipt of the return. The company may ask the consumer about the reason for withdrawal, but cannot force the consumer to state his or her reason(s).
    2. The cooling-off period referred to in paragraph 1 begins on the day after the day on which the consumer, or a third party other than the carrier and indicated by the consumer, received the product, or
  • if the consumer has ordered several products in a single order which are delivered separately: the day on which the consumer, or a third party designated by the consumer, received the last product;
  • if the delivery of a product consists of several consignments or parts: the day on which the consumer or a third party designated by the consumer receives the last consignment or part;
  • in the event of an agreement for the regular delivery of products over a certain period: the day on which the consumer or a third party designated by the consumer received the first product.

Article 6 - Availability

Our products are offered while they are visible on the website and while stocks last. For products not in stock, our offers are subject to availability from our suppliers. If a product is unavailable after you have placed your order, we will notify you by email. Your order will be automatically canceled, and no bank debit will be made. Furthermore, the website is not intended to sell its products in large quantities. Therefore, Les Esquisseurs reserves the right to refuse orders for 10 identical items.

Article 7 - Delivery

The products are delivered to the delivery address indicated during the order process, within a maximum period of 30 days. In the event of a shipping delay, an email will be sent to you to inform you of any possible consequences on the delivery time indicated to you. In accordance with legal provisions, in the event of a delivery delay, you have the option of canceling the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If you receive the product in the meantime, we will refund it and cover the shipping costs under the conditions of Article L 138-3 of the Consumer Code. In the event of deliveries by a carrier, Les Esquisseurs cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.

Article 8 - Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded. All complaints, requests for exchange or refund must be made by email within 30 days of delivery. Always contact us first in order to best analyze the situation. Following this, the products must be returned to us in the condition in which you received them with all the elements (packaging, etc.). The shipping costs will be reimbursed to you based on the invoiced rate and the return costs will be reimbursed to you upon presentation of supporting documents. However, in certain specific cases, sending simple photos may be more than sufficient (contact us beforehand). The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

The products offered comply with current French legislation. Les Esquisseurs cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibilities of importing or using the products or services you plan to order. Furthermore, Les Esquisseurs cannot be held liable for damages resulting from improper use of the purchased product. Finally, Les Esquisseurs cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.

Article 10 - Applicable law in the event of disputes

Any dispute may be resolved by email to Les Esquisseurs. The language of this contract is French. These terms and conditions of sale are subject to French law. In the event of a dispute, failing an amicable settlement, the French courts shall have sole jurisdiction.

Article 11 - Intellectual property

All designs created by Les Esquisseurs, as well as the elements of the website and social media, are and remain the exclusive intellectual property of Les Esquisseurs. No one is authorized to reproduce, exploit, redistribute, or use, in any capacity whatsoever, even partially, elements of the site, whether software, visual, or audio. Any simple or hyperlink is strictly prohibited without the express written consent of Les Esquisseurs.

Article 12 - Personal data

Les Esquisseurs reserves the right to collect personal information and data about you. This information is necessary to manage your order, as well as to improve the services and information we send you. It may also be shared with companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment. This information and data is also retained for security purposes, in order to comply with legal and regulatory obligations. In accordance with the law of January 6, 1978, you have the right to access, rectify, and oppose the processing of personal information and data concerning you.

Article 13 - Archiving Evidence

Les Esquisseurs will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. Les Esquisseurs' computerized records will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties. These general terms and conditions of sale are governed by French law and may be modified at any time without notice.

Article 14 - Late Payment Penalties for Professionals

In the event of late payment by a professional client, late payment penalties will automatically be applied. These penalties amount to a fixed percentage of 5% of the total amount of the unpaid invoice, calculated for each month of delay, with a fraction of a month counting as a full month. This penalty is due without prior formal notice from the day following the payment date indicated on the invoice.

In addition to late payment penalties, a fixed compensation for recovery costs of 40 euros will also be due, in accordance with current regulations.
